NOMOR 22 TAHUN 2002
TENTANG
GRASI

DENGAN RAHMAT TUHAN YANG MAHA ESA

PRESIDEN REPUBLIK INDONESIA

Menimbang :

a. bahwa untuk mendapatkan pengampunan berupa perubahan, peringanan, pengurangan, atau penghapusan pelaksanaan pidana yang telah dijatuhkan kepada terpidana berdasarkan putusan pengadilan yang telah memperoleh kekuatan hukum tetap, terpidana dapat mengajukan permohonan grasi kepada Presiden;

b. bahwa Undang-Undang Nomor 3 Tahun 1950 tentang Permohonan Grasi yang dibentuk berdasarkan Konstitusi Republik Indonesia Serikat, dipandang tidak sesuai lagi dengan perkembangan ketatanegaraan dan kebutuhan hukum masyarakat;

c. bahwa berdasarkan pertimbangan sebagaimana dimaksud dalam huruf a dan huruf b, perlu membentuk Undang-Undang tentang Grasi;

Mengingat :

1. Pasal 5 ayat (1), Pasal 20, dan Pasal 14 ayat (1) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945;

2. Undang-Undang Nomor 14 Tahun 1970 tentang Ketentuan-ketentuan Pokok Kekuasaan Kehakiman (Lembaran Negara Republik Indonesia Tahun 1970 Nomor 74, Tambahan Lembaran Negara Republik Indonesia Nomor 2951) sebagaimana telah diubah dengan Undang-Undang Nomor 35 Tahun 1999 tentang Perubahan Atas Undang-Undang Nomor 14 Tahun 1970 tentang Ketentuan-ketentuan Pokok Kekuasaan Kehakiman (Lembaran Negara Republik Indonesia Tahun 1999 Nomor 147, Tambahan Lembaran Negara Republik Indonesia Nomor 3879);

Dengan Persetujuan Bersama

PRESIDEN REPUBLIK INDONESIA

MEMUTUSKAN:

Menetapkan : UNDANG-UNDANG TENTANG GRASI.

CLEMENCY

BY THE GRACE OF GOD ALMIGHTY

PRESIDENT OF THE REPUBLIC OF INDONESIA

Considering:

a. that in order to obtain forgiveness in the form of change, mitigation, reduction, or elimination of the implementation of the crime have been imposed on the convicted person under a court decision which has obtained permanent legal force, the convicted person can apply for clemency to the President;

b. that Law Number 3 Year 1950 on Petition pardon which was established by the Constitution of the Republic of Indonesia States, was not commensurate with the development of constitutional and legal needs of the community;

c. Based on the considerations referred to in paragraphs a and b, it is necessary to form the Law on Pardon;

Given:

1. Article 5 paragraph (1), Article 20 and Article 14 paragraph (1) of the Constitution of the Republic of Indonesia Year 1945;

2. Law Number 14 Year 1970 on Basic Provisions on Judicial Power (State Gazette of the Republic of Indonesia Year 1970 Number 74, Supplement to the State Gazette of the Republic of Indonesia Number 2951) as amended by Act No. 35 of 1999 on the Amendment of Act Law Number 14 Year 1970 on Basic provisions on Judicial Power (State Gazette of the Republic of Indonesia Year 1999 Number 147, Supplement to the State Gazette of the Republic of Indonesia Number 3879);
